Terms of sale

Last updated: November 4, 2026.

1. General Terms of Sale

1.1 These General Terms of Sale for deliveries and services of SPLAJSER SERVIS D.O.O. ("terms of sale") apply exclusively to deliveries and services that SPLAJSER SERVIS D.O.O., with its registered office in Zagreb, Dragojla Kušlana 2, OIB 79497569112 (hereinafter: SPLAJSER SERVIS D.O.O.) provides to legal or natural persons who, at the time of concluding the contract, are engaged in their trade and/or independent business activity (companies – commercial entities), legal persons in state or partially state ownership, legal persons owned by cities, counties, municipalities or partially owned by cities, counties, municipalities, or in public-private ownership with a special legal status.

1.2 Any deviations from these terms of sale require written confirmation from SPLAJSER SERVIS D.O.O. Buyer's terms that deviate from these terms are likewise not valid, even if SPLAJSER SERVIS D.O.O. has agreed to them in writing. These terms of sale also apply when SPLAJSER SERVIS D.O.O. performs deliveries and/or services without reservation while being aware of deviating terms.

1.3 Employees of SPLAJSER SERVIS work in a quality, transparent and ethical manner, complying with all applicable laws of the Republic of Croatia and with the instructions and guidelines of the Management of SPLAJSER SERVIS. Accordingly, employees of SPLAJSER SERVIS are strictly prohibited from giving and/or accepting bribes or performing any other corrupt acts.

2. Scope of services, terms of sale and payment

2.1 Products of SPLAJSER SERVIS may not be purchased by minors or persons fully lacking legal capacity.

2.2. This website has no basket, no ordering and no payment, and prices are not published: the product page states "Price on request". You send us an inquiry through the contact form or by email, we answer it with a written quotation, and the contract comes into being when you accept that quotation.

Payment is made by bank transfer against our invoice, unless the quotation provides otherwise.

2.3 A quotation we send you is valid until the date stated in it. After that, prices, lead times and availability may change. Any special terms are agreed individually and stated in the quotation; there are no discount codes and no promotions that apply by themselves.

2.4 For payments that are visible on our account, dispatch takes place on the same or next business day; the delivery time thereafter depends on the conditions of the courier service and the delivery address. For all bank-transfer payments, we do not dispatch goods on the basis of a payment confirmation but only once the payment is visible on our bank account. We do not deliver goods on a cash-on-delivery basis. Unless otherwise agreed, goods must be paid for prior to dispatch. If, due to an error or oversight, a price in the quotation proves incorrect or changes in the meantime, we will tell you before dispatch and you may confirm or cancel the order.

If ordered goods are unavailable, SPLAJSER SERVIS will offer the buyer the most similar alternative goods and, after the buyer confirms by e-mail that the offer is acceptable, will dispatch the goods to the buyer by the chosen delivery method at the earliest the following day. If the offer is not acceptable to the buyer, SPLAJSER SERVIS will cancel the order and issue a refund no later than two business days after receipt of the buyer's written request.

2.5 The scope of services is governed by the statements of both parties. Weight and dimension data in brochures and quotations are provided to the best of our knowledge. We reserve the right to make acceptable deviations in execution as well as design changes. The functions of offered software programs and modules are limited to the description in the service specification. We further reserve the right to use nearly new or remanufactured parts.

2.6 Any reference to technical standards constitutes only a description of the service, unless SPLAJSER SERVIS assumes a warranty in the form of a guarantee obligation for compliance with those technical standards. Where guarantees of quality or durability relating to the subject matter of the contract are issued at the time of concluding the contract, they must be drawn up in writing.

2.7 SPLAJSER SERVIS retains all unlimited proprietary, copyright, and industrial property rights in drawings, technical documentation and other data, information and materials of a material or immaterial nature – including in electronic form; without the written consent of SPLAJSER SERVIS, these rights may not be made available to third parties.

3. Use of software

3.1 Where software is included in the scope of delivery, all rights of SPLAJSER SERVIS to know-how and protectable results (e.g. inventions, copyrights) remain with SPLAJSER SERVIS regardless of the obligation to deliver the software to the buyer, unless otherwise agreed. SPLAJSER SERVIS is entitled to apply without restriction the know-how acquired in connection with the performance of the contract to its own business activities.

3.2 Where software is included in the scope of delivery, SPLAJSER SERVIS hereby grants the buyer a non-exclusive and non-transferable right of use, subject to the condition set out in clause 3.8.

3.3 Where software is delivered as an integral part of a device or for a specific device, the buyer may use it only with the specified hardware or together with the hardware with which the software was delivered, unless otherwise agreed. Use of the software with any other device requires the express written consent of SPLAJSER SERVIS, even where the buyer temporarily uses the software with a replacement device of the same type due to a hardware fault.

3.4 Where software is delivered as an integral part of a device, the transfer of user documentation requires an express written agreement. The transfer of maintenance and service documentation requires a separate written agreement in all cases. When documentation is transferred, the term "software" within the meaning of these terms and conditions includes the documentation.

3.5 Unless SPLAJSER SERVIS expressly grants the buyer a multiple licence, the buyer receives only a single licence to the software, i.e. the buyer may use the software simultaneously on only one device or one workstation at a time. In the case of a multiple licence, the buyer must comply with the reproduction instructions received from SPLAJSER SERVIS and must record the location of each copy made. These records must be presented to SPLAJSER SERVIS upon request.

3.6 Except where decompilation is permitted under the assumptions of the Copyright and Related Rights Act (always in the version currently in force), the buyer has no right to modify, develop, translate, extract parts of, or link the software with other programs. The buyer may not remove alphanumeric or other passwords or manufacturer's data from data carriers – in particular copyright notices – and must transfer them unchanged to every backup copy.

3.7 A buyer who has received a device together with software, where the right of use of the software is not transferred for the purpose of professional resale, may transfer the right of use of the software to third parties only together with the device. In all other cases, further transfer of the software to third parties and/or assignment of rights of use to third parties is permitted only with the prior written consent of SPLAJSER SERVIS. In the event of a transfer of rights of use to third parties, the buyer must ensure that no further transferable rights of use of the software are granted to the third party beyond those granted by SPLAJSER SERVIS to the buyer, and that the third party is bound by at least the same obligations already applicable to the software under the agreements with SPLAJSER SERVIS. Upon resale, the buyer may not retain any copy of the software. Multiple licences may only be resold in their entirety. The buyer has no right to grant sub-licences. Upon resale, the buyer is responsible for compliance with any applicable export requirements/regulations and must in this respect indemnify SPLAJSER SERVIS against all obligations/sanctions.

3.8 Where third-party software is made available to the buyer – i.e. software for which SPLAJSER SERVIS holds only an implementation right of use or so-called "open source" software – the terms of use agreed between SPLAJSER SERVIS and its licensor or the terms of use applicable to the "open source" software take precedence over the provisions of this clause 3, and SPLAJSER SERVIS will make them available to the buyer upon request. In the event of a breach of these terms of use by the buyer, the licensor of SPLAJSER SERVIS is also entitled, in its own name, to assert claims and rights arising from such breach.

3.9 The buyer undertakes to keep the software and any documentation carefully so as to preclude misuse.

3.10 SPLAJSER SERVIS does not automatically undertake to provide software servicing. A separate agreement is required for this purpose.

4. Delivery and delivery periods

4.1 Goods are delivered by courier service.

4.2 SPLAJSER SERVIS is entitled to make partial deliveries where this is acceptable to the buyer.

4.3 Compliance with delivery and service deadlines presupposes that all commercial and technical issues between SPLAJSER SERVIS and the buyer have been clarified and that the buyer has fulfilled all of its obligations, such as providing the required materials, other supplements, permits or certificates, or making payments. If this is not the case, the delivery period is extended by a corresponding period. This does not apply where SPLAJSER SERVIS is at fault for the delay.

4.4 The delivery period is deemed to have been met if notice that the goods are ready for dispatch is given before the deadline expires. Where acceptance (final inspection) follows, the relevant date is the date of acceptance – except in the case of a justified refusal to accept – or the notification of readiness for acceptance.

4.5 Delivery and service deadlines are extended proportionally in cases of force majeure (in particular natural disasters), machine breakdowns and other operational disruptions, measures taken within the legal framework in proceedings between employees and employers (in particular strikes and lockouts), as well as in the event of unforeseeable obstacles and incorrect or late delivery, provided this is not the fault of SPLAJSER SERVIS. If delivery or service becomes impossible due to the above circumstances, SPLAJSER SERVIS is entitled to withdraw from the contract.

4.6 Where the buyer purchases software from SPLAJSER SERVIS in the form of licences and/or electronic software delivery (ESD), the buyer is obliged to verify/confirm the accuracy and content of the e-mail address provided at the time of purchase/order to SPLAJSER SERVIS, as that e-mail address will be used as a reference address within a period of no more than 7 days after the order. An e-mail containing a link and the username and password for accessing the licence portal will be sent to the buyer's e-mail address. The buyer is required to log in for the first time using the password received from SPLAJSER SERVIS (as described above) and may thereafter change the password at their discretion. On the licence portal the buyer may download licences and/or ESD. If the buyer does not do so within the prescribed period, SPLAJSER SERVIS accepts no responsibility that the buyer will again be able to access the relevant data as described above, and SPLAJSER SERVIS reserves the right to charge the buyer for any additional costs incurred if regaining access to the aforementioned data causes additional expense for SPLAJSER SERVIS.

The buyer is obliged to retain any media delivered at the time of licence purchase, as in the event of their loss SPLAJSER SERVIS will not be able to re-supply the installation media unless the latest current version of the software held by SPLAJSER SERVIS is involved. Where the buyer purchases software in the form of a retail package, the buyer is obliged to retain the software installation and the serial number received, as SPLAJSER SERVIS is unable to obtain the serial number and media received by the buyer in such case (this is a condition imposed by the software manufacturer).

5. Retention of title

5.1 Delivered and/or installed items as well as the right of use of software ("sale subject to retention of title") remain the property of SPLAJSER SERVIS until full payment of all – including future – claims arising from the business relationship with the buyer, regardless of the legal basis, even where payments have been made in respect of specific claims.

5.2 Processing and/or transformation of goods subject to retention of title is carried out by SPLAJSER SERVIS, which retains ownership subject to retention of title over the goods at all times and at every stage of processing. Such processing and/or transformation is carried out free of charge and without any obligation on the part of SPLAJSER SERVIS.

Where the buyer processes, combines or mixes the goods with other movable property not belonging to SPLAJSER SERVIS, SPLAJSER SERVIS acquires co-ownership of the new item in the ratio of the invoice value of the goods subject to retention of title to the other items used by the buyer at the time of processing, combining or mixing. The new item resulting from processing, combining or mixing is otherwise subject to the same provisions as the goods subject to retention of title.

In the event of the goods subject to retention of title being combined with buildings or other constituent parts of land, the buyer undertakes, in the event of a payment default and upon request by SPLAJSER SERVIS, to effect separation of the goods subject to retention of title and to transfer ownership of those items back to SPLAJSER SERVIS. These items are then treated as goods subject to retention of title within the meaning of these terms and conditions. Rights of retention are excluded, in particular in respect of substitution of use of those items.

5.3 The buyer is entitled to resell goods subject to retention of title in the ordinary course of business, provided that the buyer maintains retention of title over the goods in accordance with the provisions of this clause 5. The buyer hereby assigns to SPLAJSER SERVIS, as of now, all claims arising from the resale of goods subject to retention of title and from the retention of ownership agreed as security for all – including future – claims of SPLAJSER SERVIS arising from the business relationship, regardless of whether the goods subject to retention of title have been resold without or after processing and whether they have been resold to one or more buyers. SPLAJSER SERVIS accepts this assignment.

The buyer retains the right to collect the assigned claims even after this assignment. The authority of SPLAJSER SERVIS to collect the assigned claims itself remains unaffected by this. SPLAJSER SERVIS will nevertheless not collect the claims for as long as the buyer is duly fulfilling its payment obligations, as long as SPLAJSER SERVIS has not revoked the authority to collect, and as long as no application has been made for the opening of insolvency/liquidation/pre-insolvency settlement or similar proceedings against the buyer.

Upon request, the buyer must immediately notify SPLAJSER SERVIS in writing to whom the delivery items have been sold, what claims arise from the sale, and must surrender the documents necessary for their enforcement.

5.4 The buyer is not entitled to dispose of goods subject to retention of title in ways other than those referred to in clauses 5.2 and 5.3, in particular not to pledge them or transfer them as security. Upon request by SPLAJSER SERVIS, the buyer is obliged to notify the assignment to its buyer for payment purposes.

5.5 If the buyer acts in breach of contract, in particular in the event of a payment default, SPLAJSER SERVIS is entitled to reclaim the goods subject to retention of title following a warning and withdrawal from the contract, and the buyer is obliged to surrender the goods. An application for the opening of insolvency/liquidation/pre-insolvency settlement or similar proceedings against the buyer entitles SPLAJSER SERVIS to withdraw from the contract with immediate effect and to demand immediate return of the goods subject to retention of title.

5.6 The buyer must immediately notify SPLAJSER SERVIS of any pledging, attachment or other disposal and third-party interventions. If the third party is unable to reimburse SPLAJSER SERVIS for court and out-of-court costs in the event of cessation of operations, the buyer shall indemnify SPLAJSER SERVIS for the same.

5.7 The buyer undertakes to fully cooperate with SPLAJSER SERVIS in protecting SPLAJSER SERVIS's proprietary rights over the delivery item in accordance with the legislation of the place of delivery and destination under the above agreements.

6. Complaints and acceptance

6.1 Upon receipt, the buyer must immediately inspect the delivery to determine the quantities received and any damage caused in transit. In the event of damage caused in transit, a damage report must be drawn up in order to preserve any claims for compensation against the carrier (post, railway, freight forwarder, etc.). SPLAJSER SERVIS must be notified of this damage report immediately.

6.2 Defects may be claimed exclusively in writing and exclusively within 7 days from the date of receipt of the goods, even where the defect in question is not apparent. Latent defects and defective performance of other services must be reported to SPLAJSER SERVIS in writing immediately upon discovery.

6.3 If the buyer is prevented by circumstances as referred to in clause 6.4 of these general terms and conditions from carrying out acceptance, both the acceptance period and the complaint period following the above sale are extended by a reasonable period of time.

6.4 Where a service has been provided and acceptance has been expressly agreed, SPLAJSER SERVIS notifies the buyer in writing that the work is complete and ready for delivery. If acceptance is delayed for reasons for which SPLAJSER SERVIS is not at fault, the service is deemed to have been performed 14 days after the written notification of readiness for acceptance. SPLAJSER SERVIS undertakes in such case to draw the buyer's attention to the fact that the product is deemed accepted. This equally applies to partial acceptances.

6.5 Complaints are handled in accordance with the manufacturer's specifications for the product purchased. Service and spare parts are provided by the authorised representative for Croatia. When reporting a defective product, it is necessary to enclose a copy of the invoice, the warranty card, a description of the defect, and the complete documentation and original packaging. The warranty does not cover damage caused by improper handling, mechanical damage, damage caused by lightning strikes, excessive voltage, or wear and tear of the device.

7. Return of conforming goods

7.1 These terms of sale apply to business buyers, as set out in clause 1.1. A business buyer has no statutory right to withdraw from the contract without giving a reason.

7.2 A business buyer may return conforming goods only with our prior written consent. In that case the goods are returned at the buyer’s expense, undamaged and in the original packaging, to the address of SPLAJSER SERVIS, marked RETURN OF CONFORMING GOODS, together with a copy of the invoice and the warranty card. Returns do not cover goods made or sourced to the buyer’s specification.

7.3 If you are a consumer, that is a natural person buying outside your trade or profession, you have statutory rights that these terms cannot limit and that take precedence over them. A contract concluded at a distance, for example by an exchange of emails following an inquiry, may be withdrawn from by a consumer within 14 days of receiving the goods, without giving a reason, except in the cases the Consumer Protection Act excludes, such as goods made to the consumer’s specification. It is enough to send notice of withdrawal by email to info@splajser.com.

7.4 A consumer who withdraws bears the cost of returning the goods. The goods need not be returned in the original packaging, but the consumer is liable for any diminished value if the goods were handled more than was necessary to establish their characteristics. We refund what was paid within 14 days of receiving the notice of withdrawal, by the same means of payment, unless we agree otherwise.

7.5 For a refund we need the following details:

  • First and last name of the payer, or company/sole trader name
  • IBAN (International Bank Account Number)
  • Name of the bank at which the account is held
  • Address of the account holder, or the registered address of the company/sole trader
  • OIB of the account holder, or OIB of the company/sole trader

8. Defects in deliveries or services

8.1 If there is a defect in the deliveries or services of SPLAJSER SERVIS and it has been reported in a timely manner within the meaning of clause 6.2 of these terms of sale, SPLAJSER SERVIS will, at its choice, repair it free of charge or deliver a new item ("subsequent performance/remedy"), provided the defect existed at the time of the transfer of risk. In the case of defects in software, SPLAJSER SERVIS is entitled to deliver a new version of the software in order to carry out the repair.

8.1.1 The period for collecting a timely reported defect (within the meaning of clause 6.2 of these general terms of sale) in deliveries or services of SPLAJSER SERVIS (repaired or new product) expires 60 days from the moment SPLAJSER SERVIS has called upon the buyer to collect the repaired product or the new product, or the new version of the software.

8.1.2 After the above period, SPLAJSER SERVIS is no longer obliged to store the repaired product or to deliver a new product and/or software.

8.1.3 If the warranty period has expired, SPLAJSER SERVIS is entitled to charge the buyer for fault diagnosis.

8.2 A defect is deemed not to exist if the item is fit for normal use and possesses qualities that are customary in items of the same type and which the buyer can expect. The buyer is in particular aware that under the current state of the art it is not possible to produce software that is entirely error-free. The usability of single-use products is limited to first use. Furthermore, a defect is deemed not to exist in the case of incorrect assembly instructions, provided that the assembly has been carried out correctly. If SPLAJSER SERVIS delivers an item that differs only slightly from the agreed item, or a quantity that is only slightly different from the agreed quantity, no defect is deemed to exist. A defect is likewise deemed not to exist in the case of inappropriate or improper use, incorrect storage, incorrect assembly or commissioning by the buyer or by third parties, normal wear and tear, incorrect or negligent handling, improper maintenance, use of unsuitable operating materials, deficient construction work, chemical, electrochemical or electrical influences for which SPLAJSER SERVIS is not responsible, software errors that cannot be reproduced, and defects that do not occur in the version of the software last delivered to the buyer by SPLAJSER SERVIS, provided that the use of the version last delivered to the buyer is acceptable.

8.3 In order for SPLAJSER SERVIS to take all measures of subsequent performance it considers necessary, the buyer must, following agreement, give SPLAJSER SERVIS the required time and opportunity, and in particular must, upon request, send the delivery item to SPLAJSER SERVIS or to a workshop that SPLAJSER SERVIS may designate from case to case; otherwise SPLAJSER SERVIS is released from liability for the consequences that may result. Defects in the delivered software must be described in as much detail as possible. Only in urgent cases of risk to safety or to avert disproportionately large damage – in which case SPLAJSER SERVIS must be immediately notified in writing – does the buyer have the right to remedy the defect itself or to engage third parties to do so, and to claim from SPLAJSER SERVIS reimbursement for the necessary documented expenditure.

8.4 The buyer's claims for expenses incurred in connection with subsequent performance, in particular transport, road, labour and material costs, are excluded where they impose a disproportionate burden on SPLAJSER SERVIS or where the costs are increased because the delivery item has been moved to a place other than the agreed place of delivery. SPLAJSER SERVIS may also refuse subsequent performance if it involves disproportionate costs.

8.5 Replaced parts become the property of SPLAJSER SERVIS.

8.6 The buyer is entitled to withdraw from the contract if subsequent performance fails twice or if SPLAJSER SERVIS allows a reasonable deadline set for subsequent performance to pass without result. If the conditions for withdrawal are met but the defect is only minor, the buyer is only entitled to a reduction of the contract price. The right to a reduction of the contract price is otherwise excluded.

8.7 If the buyer or a third party repairs the item improperly (unauthorised repairer), SPLAJSER SERVIS accepts no liability for the consequences that may arise. The same applies to modifications of the delivery item made without the prior consent of SPLAJSER SERVIS, or to extensions of the software made by the buyer or a third party outside the interfaces provided by SPLAJSER SERVIS.

8.8 The buyer cannot claim warranty for defects if the defect was known to the buyer at the time the contract was concluded, or was unknown to the buyer through gross negligence. This does not apply where SPLAJSER SERVIS fraudulently concealed the defect or gave a quality guarantee covering it.

8.9 For used delivery items, with the exception of nearly new and remanufactured parts, warranty for defects is excluded in accordance with clause 9.

8.10 The statute of limitations on the buyer's claims for warranty for defects under this clause 8 is twelve (12) months from delivery of the delivery item in the case of a sales contract and a supply-from-factory contract, or – if agreed – from commissioning of the delivery item or acceptance of the service. The above limitation period does not apply where it conflicts with applicable mandatory law.

8.11 Further or other claims by the buyer relating to quality defects governed by this clause 8 against SPLAJSER SERVIS or its auxiliary persons in performance are excluded.

9. Intellectual property rights, legal defects

9.1 Unless otherwise agreed, SPLAJSER SERVIS undertakes to effect delivery only to the place of delivery, free of intellectual property rights of third parties ("protective rights"). If a third party asserts justified claims against the buyer for infringement of protective rights through deliveries of SPLAJSER SERVIS that are used in accordance with the contract, SPLAJSER SERVIS warrants to the buyer within the period specified in clause 9.10 of these general terms of sale under the following provisions.

9.2 SPLAJSER SERVIS will, at its choice and at its own expense, obtain the relevant services or the right of use, modify them so that the protective right is not infringed, or replace them. If this is not possible for SPLAJSER SERVIS under reasonable conditions, the buyer is entitled to withdraw or to a reduction in accordance with clause 7.6 of these general terms of sale. For claims for damages, clause 9 of these general terms of sale applies. The above obligations exist only if the buyer immediately notifies SPLAJSER SERVIS in writing of claims made by third parties, does not acknowledge the infringement to the third party, and SPLAJSER SERVIS retains the right to all defensive measures and settlement negotiations. If the buyer ceases use of the service, the buyer undertakes to indicate to third parties that the cessation of use is not associated with any acknowledgement of infringement of the protective right.

9.3 If the infringement of the protective right is the buyer's own fault and/or where it is caused by the buyer's specifications, by an application that SPLAJSER SERVIS could not have foreseen, by a modification made by the buyer, or by use of the service together with products not supplied by SPLAJSER SERVIS, the buyer's claims for damages are excluded.

9.4 For other legal defects, clause 10 of these general terms and conditions applies. The buyer's claims for damages are governed by clause 11 of these general terms of sale.

9.5 Further claims or claims by the buyer not governed by this clause 9 against SPLAJSER SERVIS or its auxiliary persons in performance, relating to legal defects, are excluded.

10. Liability of SPLAJSER SERVIS for defects

10.1 SPLAJSER SERVIS is liable for damages only in cases of intent or gross negligence. In all cases, SPLAJSER SERVIS is liable exclusively for direct damage and in no event for loss of use, loss of profit, or non-material damage of any kind.

10.2 The maximum amount of compensation that the buyer may claim from the seller is limited to the purchase price of the delivery item in connection with which the damage arose.

10.3 The buyer must take all necessary and reasonable measures to prevent or limit damage, and must in particular ensure regular backup of programs and data. In the case of data recovery, SPLAJSER SERVIS warrants, subject to the conditions of clauses 11.1 and 11.2, only where the buyer has ensured that those data can be reconstructed from other data at reasonable cost.

10.4 Further claims for damages or other claims for damages not governed by this clause 9 against SPLAJSER SERVIS or its auxiliary persons in performance – regardless of the legal basis – are excluded.

11. Information on the website

SPLAJSER SERVIS makes every effort to keep the information on the website splajser.com up to date and accurate. SPLAJSER SERVIS cannot guarantee one hundred percent accuracy of all displayed information on products and services. In exceptional cases, deviations may occur between actual data and data available on the website. SPLAJSER SERVIS undertakes in each such case to review the order and to contact the buyer to personally agree on alternatives. Likewise, product photographs do not always have to correspond to the products actually available and should be understood only as informational illustrations. For any additional information, please contact the SPLAJSER SERVIS sales department.

12. Data protection

Pursuant to the EU Data Protection Directive and applicable laws in force, SPLAJSER SERVIS will process and store data on the buyer obtained in connection with the business relationship for the company's own purposes.

SPLAJSER SERVIS undertakes to protect the personal data of buyers by collecting only the necessary, basic data about buyers/users that is required for the fulfilment of our obligations; and by informing buyers about the manner in which the collected data is used. We do not use buyers’ data for marketing campaigns and keep no such lists. All user data is strictly protected and accessible only to employees for whom such data is necessary to perform their work. All employees of SPLAJSER SERVIS and business partners are responsible for compliance with the principles of privacy protection.

13. Safety provisions

The buyer is responsible for compliance with national laws, regulations and safety/legal regulations, particularly in connection with the approval, installation, operation, maintenance and repair of the delivery items, and is obliged to fulfil them. The buyer undertakes to indemnify SPLAJSER SERVIS against all claims arising from the buyer's non-compliance with such regulations.

14. Competent court, applicable law, acknowledgement of the General Terms of Sale

14.1 For all potential disputes arising from/in connection with the delivery of products/software/services, the jurisdiction of the competent court in Zagreb is agreed.

14.2 The applicable law is the law of the Republic of Croatia in force. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.

14.3 By sending us an inquiry and accepting our quotation, you agree to these General Terms of Sale.

14.4 Every buyer of products/software/services of SPLAJSER SERVIS is deemed to be aware of these General Terms of Sale (always in the version in force) and of all legal consequences arising therefrom, by virtue of their publication on the SPLAJSER SERVIS website and the placing of an order for products/software/services of SPLAJSER SERVIS.

14.5 SPLAJSER SERVIS reserves the right to amend and supplement these General Terms of Sale, and will publish and make them available on the SPLAJSER SERVIS website. Amendments and supplements enter into force on the date of publication.
